C5966-1516-102 <br /> � ati <br /> THIS AGREEMENT (hereinafter referred to as the "Agreement") is made in duplicate, <br /> this 2"r'day of AuCtu Cr 2016, by and between the CITY OF SUNNY ISLES BEACH, <br /> (hereinafter referred to as "City"), and SOUTHERN UNDERGROUND INDUSTRIES, INC., <br /> a corporation authorized to do business in the State of Florida (hereinafter referred to as <br /> "Contractor") whose Federal I.D. # is 2(0— 2.52. ti <br /> RECITALS <br /> WHEREAS, the City is in need of a general contractor to provide continuing services on <br /> an as-needed basis, for small construction projects throughout the City ("Services"), as more <br /> particularly described in Invitation to Bid No. 14-10-02,which is incorporated herein by reference; <br /> and <br /> WHEREAS,on December 18, 2014 via Resolution No.2014-2352, the City Commission <br /> awarded Bid No. 14-10-02 and the Contractor submitted a bid in response thereto,a copy of which <br /> is attached hereto as Attachment"A" and made a part hereof; and <br /> WHEREAS, the City desires to contract with Contractor to provide the Services,as more <br /> fully described in Attachment`B"which is attached hereto; and <br /> NOW THEREFORE, in consideration of the foregoing and for the mutual covenants, <br /> representations and warranties and other good and valuable consideration, the receipt and <br /> adequacy of which is hereby acknowledged,the parties agree as follows: <br /> 1. RECITALS. The Recitals set forth above are hereby incorporated into this agreement and <br /> made a part hereof for reference. <br /> 2. SERVICES. Contractor shall perform the following services including, driveway, <br /> sidewalk, and curbing repairs at several locations on Atlantic Boulevard, ("Services") as more <br /> particularly described in Attachment "B". The Services shall be performed by Contractor to the <br /> full satisfaction of the City. Contractor agrees to have a qualified representative to audit and <br /> inspect the Services provided on a regular basis to ensure all Services are being performed in <br /> accordance with the City's needs and pursuant to the terms and conditions of this Agreement and <br /> Invitation to Bid No. 14-10-02, which is incorporated herein by reference, and shall report to the <br /> City accordingly. Contractor agrees to immediately inform the City via telephone and in writing <br /> of any problems that could cause damage to the City's property, improvements and persons. <br /> Contractor will require its employees to perform their work in a manner befitting the type and <br /> scope of work to be performed. <br /> 3. CONTRACT DOCUMENTS. The Contract Documents include this Agreement, the <br /> terms and conditions of Invitation to Bid No. 14-10-02, Contractor's response to Invitation to Bid <br /> No. 14-10-02, and Contractor's proposal for the Services described herein, collectively referred to <br /> as the"Contract Documents." <br /> C5966-1516-102-SOUTHERN UNDERGROUND INDUSTRIES,INC. <br /> g <br />
