Associates VIII, Inc. <br /> <br />RECOMMENDA TION: <br /> <br />It is recommended that the City Commission approve the attached Resolution approvmg an <br />Agreement for the purchase of property from R.K. Associates VIII, Inc. <br /> <br />BACKGROUND: <br /> <br />By Resolution No. 2009-1401, passed and adopted on April 16, 2009, the City Commission of <br />Sunny Isles Beach declared the public purpose and necessity to acquire fee simple title to the <br />property located at 151 Sunny Isles Boulevard for the development of a public park and public <br />parking facility. Resolution No. 2009-1401 further authorized the City to acquire title to the <br />property through eminent domain or voluntary negotiations for the development of a public park <br />and public parking facility. Through voluntary negotiations between the parties, the City and <br />R.K. Associates VIII, Inc. were successful in negotiating the agreement for the purchase and sale <br />of the property. <br /> <br />The parcel located at 151 Sunny Isles Boulevard is the optimal location for expansion and <br />development of the City's park system and public parking facilities and the acquisition of the <br />subject parcel in fee simple serves a municipal purpose and is necessary for development of the <br />City's park system and public parking facilities, in accordance with the City's Comprehensive <br />Plan and Open Space Plan. <br /> <br />TERMS AND CONDITIONS OF AGREEMENT: <br /> <br />Notable terms and conditions of the agreement include the following: <br /> <br />1. R.K.
