<br />f") <br /> <br />) <br /> <br />8.01.02 <br /> <br />10 <br /> <br />8.01.03 <br /> <br />) <br /> <br />8.01.04 <br /> <br />A V-CHOICE-2009 <br />MP-5320 (10/09) <br /> <br />a) Upon a loss of the Subscriber's or Dependent's eligibility as defined in Part III, <br />coverage shall automatically tenninate on the last day of the month for which the <br />monthly premium was paid and during which the Subscriber and/or Dependent was <br />eligible for coverage. <br /> <br />b) Coverage for all Dependents shall automatically terminate on the last day of the month <br />for which the monthly premium was paid upon a loss of the Subscriber's eligibility, as <br />defined in Part III. <br /> <br />Failure to Make Premium Payment. Upon failure of the Subscribing Group to make payment <br />of the monthly premium provided in Part VI within 10 days following the due date specified <br />herein, benefits hereunder shall terminate, for all Subscribers and any Dependents for whom <br />such payment has not been received, at 12:00 a.m. (midnight) on the last day of the month <br />for which the monthly premium was paid. <br /> <br />a) AvMed, regarding cancellation or non-renewal of this coverage, may retroactively <br />cancel the policy to the date for which the Subscribing Group's premiums have been <br />paid, when AvMed provides notice of cancellation or non-renewal to the Subscribing <br />Group prior to 45 days after the date the premium was due. AvMed will include a <br />reason for the Contract termination in its written notification to the Subscribing Group. <br />The Subscribing Group will forward such notification to all Subscribers when AvMed <br />has notified the Subscribing Group of the cancellation or non-renewal, and AvMed is <br />deemed to have complied with its notification requirements by providing said notice to <br />the Subscribing Group. <br /> <br />Termination of Group Contract by Subscribing Group. Subscribing Group may terminate <br />this Group Contract on the anniversary date by giving written notice to AvMed 15 days prior <br />to Contract anniversary date. In such event, benefits hereunder shall tenninate for all <br />Members at 12:00 a.m. (midnight) on the Contract expiration date as described below. <br /> <br />a) Early Termination of Group Contract by Subscribing Group. Subscribing Group may <br />terminate this Group Contract by giving at least 60 days written notice to AvMed. In <br />such event, benefits hereunder shall terminate for all Members at 12:00 a.m. (midnight) <br />on the date specified by the Group in their written notice to AvMed and for which <br />premium was paid. <br /> <br />Tennination of Group Contract by AvMed. AvMed may non-renew or discontinue this Group <br />Contract based on one or more of the conditions listed below. In such event, benefits <br />hereunder shall terminate for all Members at 12:00 a.m. (midnight) on the Contract <br />expiration date as described below. <br /> <br />a) Subscribing Group has failed to pay premiums or contributions in accordance with the <br />terms of this Contract or AvMed has not received timely premium payments (See Part <br />VI, Monthly Payments and Co-payments and Subsection 8.01.02). Termination of <br />coverage will be effective on the last day of the month for which payments were <br />recoived by AvMed. <br /> <br />b) Subscribing Group has performed an act or practice that constitutes fraud or made an <br />intentional misrepresentation of material fact under the terms of this Contract. This will <br />result in immediate termination of Subscribing Group. <br /> <br />c) Subscribing Group has failed to comply with a material provision of the Contract that <br />relates to rules for employer contributions or group participation. Termination will be <br />effective upon 45 days written notice from AvMed to Subscribing Group. <br /> <br />16 <br />
