Section 2. Award of Bid and App ruyal of A reek1jent. The City Commission hereby awards Bid <br />No. 08 -06-01 to and enters into an agreement with Tenex I?nterprises for Atlantic Isles Roadway and <br />Utility Improvements, in an amount not to exceed Two Million Eight Hundred Eighty -Five <br />Thousand Forty - Fight Dollars ($2,885,048.00), in substantially the same form as the agreement <br />attached hereto as Exhibit "A ", provided that agreement is approved as to form and legal sufficiency <br />by the City Attorney, based on the pricing, terms, and conditions listed in the bid response, attached <br />hereto as Exhibit "B ". <br />Section 3. Authorization of Mayor. The Mayor is hereby authorized to execute said Agreement. <br />Section 4. Authorization of City Manager. The City Manager is hereby authorized to do all <br />things necessary to effectuate the terms of this Agreement. <br />Section 5. Effective Date.
