<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />SECTION 00800 <br /> <br />FIRST AMENDED SUPPLEMENTARY CONDITIONS <br /> <br />The following supplements modify, change from or add to the Standard General Conditions of <br />the Construction Contract, EJCDC Document 1910-8, 1996 Edition. Where any Article of the <br />General Conditions is modified or any Paragraph, Subparagraph or Clause thereof is modified <br />or deleted by these supplements, the unaltered provisions shall remain in effect. <br /> <br />ARTICLE 1 - DEFINITIONS AND TERMINOLOGY <br /> <br />Add the following sentence to Paragraph 1.01.28 entitled "Notice of Award": <br /> <br />"When requested by OWNER, the Notice of Award may be issued by the <br />ENGINEER." <br /> <br />Add the following sentence to Paragraph 1.01.29 entitled "Notice to Proceed": <br /> <br />"When requested by OWNER, the Notice to Proceed may be issued by <br />ENGINEER." <br /> <br />Add the following terms after Paragraph 1.01 50: <br /> <br />1.51 ARCHITECT/ENGINEER - The person, firm or corporation named as the <br />ENGINEER in the Agreement. <br /> <br />1.52 Provide - As used in the Project Manual, means to furnish and install, <br />complete and ready for intended use. <br /> <br />1.53 Product - As used in the Project Manual, includes materials, fabrications, <br />systems and equipment. <br /> <br />1.54 Project Manual - The volume of written construction documents, including <br />the Bidding Documents, sample forms, and the Contract Documents, such as the <br />Conditions of the Contract and the Specifications. <br /> <br />1.55 Retainage - The percentage of the Contract Price, retained by Owner from <br />the progress payments to the Contractor for Work performed until the Work is <br />completed. It shall be payable to Contractor in accordance with the Contract <br />Documents. <br /> <br />ARTICLE 2 - PRELIMINARY MATTERS <br /> <br />Add the following to Paragraph 2.01: <br /> <br />"If the Work is to be commenced prior to execution of the Agreement in response <br />to a letter of intent, CONTRACTOR shall, prior to commencement of the Work, <br />submit evidence satisfactory to OWNER that such bonds will be furnished." <br /> <br />In the first line of Paragraph 2.02. change the term "...ten..." to read: <br /> <br />04/08 Final Version <br /> <br />00800-1 <br />
