S~ <br />CITY OF SUNNY ISLES BEACH (hereinafter called OWN R) arid <br />(hereinafter called CONTRACTOR). <br /> <br />in the year 20 0 ~by and between <br />Merkurv Development <br /> <br />OWNER and CONTRACTOR, in consideration of the mutual covenants hereinafter set forth, agree as <br />follows: <br /> <br />Article 1. WORK. <br /> <br />CONTRACTOR shall complete all Work as specified or indicated in the Contract Documents. The Work <br />is generally described as follows: <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Proiect Title and Description of Work <br />Sunny Isles Beach: City Hall Improvements <br /> <br />1. New storefront glass enclosure for existing east stair, 1 sl floor. <br />2. New concrete roof over existing Post office, 1 sl floor. 1 sl floor ceiling of the existing Garage <br />Building shall be cleaned, primed, and painted. Only the 1 sl floor ceiling is to be painted, which <br />means that all other ceilings will not be painted. Please refer to the Specifications Book for <br />painting materials and execution. <br />3. New vestibule entrance for existing Council Chambers, 1 sl floor. <br />4. New storefront glass in front of existing elevator doors, 2nd floor. <br />5. New floor drains installed into existing concrete slab, 3rd floor. <br />6. New galvanized steel canopy over exiting elevator doors, 3rd floor. <br />7. New entrance into existing building, connecting 3rd floor parking with 3rd floor offices, incl. steel <br />stair. <br />8. New entrance to existing Generator Room <br /> <br />Article 2. ARCHITECT <br /> <br />The Project has been designed by: <br /> <br />Cubellis <br />1800 Eller Drive, Suite 500 <br />Fort Lauderdale, FL 33316 <br />(954) 961-6806 <br /> <br />who is hereinafter called ARCHITECT and who is to act as OWNER'S representative, assume all duties <br />and responsibilities and have the rights and authority assigned to ARCHITECT in the Contract Documents <br />in connection with completion of the Work in accordance with the Contract Documents. <br /> <br />Article 3. CONTRACT TIMES. <br /> <br />3.1. The work will be substantially completed within 270 calendar days after the date when the <br />Contract Times commence to run completed and ready for final payment in accordance with <br />paragraph 14.07 of the General Conditions within 300 calendar days after the date when the <br />Contract Times commence to run. <br /> <br />3.2. L1QUlDA TED DAMAGES. OWNER and CONTRACTOR recognize that time is of the essence <br />of this Agreement and that OWNER will suffer financial loss if the Work is not completed within the <br />times specified in paragraph 3.1 above, plus any extensions thereof allowed in accordance with <br />Article 12 of the General Conditions. They also recognize the delays, expense and difficulties <br />involved in proving the actual loss suffered by OWNER if the Work is not completed on time. <br />Final Version 00500-1 <br />
