Hines, Cit)' Clerk <br /> <br />MEMORANDUM <br /> <br />The Honorable City commiSSi\~ <br /> <br />Hans Ottinot, City Attorney\!\? ~ <br />January 17,2008 <br /> <br />Resolution Approving an Agreement between the State of Florida and the City <br />regarding submerged lands lease for the Pier (Agenda Item lOG) <br /> <br />RECOMMENDA TION: <br /> <br />It is recommended that the City Commission approve the attached Resolution approvIng a <br />submerged land lease in substantially the same form with the State of Florida. <br /> <br />REASONS: <br /> <br />The owner of the Newport Fishing Pier, located at 1670 I Collins A venue, has asked the City to <br />take over the pier's operation. The pier sustained major structural damage during Hurricane <br />Wilma in 2005, and as a result, has been closed to the public. Dr. Robert Cornfeld, owner of the <br />Newport Hotel and the City recently agreed to a public private partnership whereby the parties <br />would allocate certain funds for the design, removal and replacement of the entire pier structure. <br /> <br />However, in order to effectuate this agreement, it is necessary for the City to enter into a <br />submerged lands lease with the State of Florida to operate the pier. The Newport Hotel was the <br />previous lessee with the State of Florida for the pier from 1984 through April 23, 2007. By <br />entering into the submerged lands lease, the City would be taking a necessary step to repair the <br />damaged pier. The negotiations with the State of Florida are on going. In the attached proposed <br />lease, the City has asked the State for five years to repair the Pier. The City has also asked the <br />State to waive the fees for the lease agreement because the City intends to use the revenue from <br />the Pier to maintain the Pier. <br /> <br />HO: faljb <br /> <br />/ Attachment <br />
