<br /> THIS NINTH AMENDMENT to the Agreement between the City of Sunny Isles Beach("City"
<br /> and Lukes' Landscaping, Inc.,d/b/a/Lukes-Sawgrass Landscape, Inc.,("Contractor")executed this 15
<br /> day of M qEr , 2016, is made a part of the original Agreement between the parties dated
<br /> August 21, 2012, Contract No. 1112-057 ("the Agreement") between the City and Contractor attached
<br /> hereto as Attachment"B",whose Federal Identification#is 59-1587233. The City and Contractor hereby
<br /> agree as follows:
<br /> 1. SERVICES TO BE PERFORMED. The Scope of Services, as set forth in Section Two of the
<br /> Agreement between the parties, is hereby amended to include Right of Ways, Parks, and Beach Access
<br /> landscaping services("Additional Services"),as more particularly described in Attachment"A",a copy of
<br /> which is attached hereto and made part hereof.
<br /> 2. OPTION TO RENEW. Pursuant to Section Four of the Agreement between the parties, the City
<br /> hereby exercises its fourth and final optional one (1) year renewal term. The term of this renewal shall
<br /> • commence on October 15,2016 and shall terminate no later than October 14,2017.
<br /> •

<br /> 3. COMPENSATION FOR THIS NINTH AMENDMENT. The payment to the Contractor, as
<br /> set forth in Section Five of the Original Agreement, is hereby amended to include Compensation for the
<br /> Services to be perfornied for this one (1) year renewal term during Fiscal Year 2016-2017, in an amount
<br /> not to exceed Eight Hundred Eighty Six Thousand Six Hundred Twenty Nine Dollars($886,629.00).

<br /> 4. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically modified herein, all
<br /> terms and conditions of the original Agreement between the parties, dated August 21, 2012, shall remain
<br /> in full force and effect.
<br /> 5. CONFLICTING PROVISIONS. The terms and provisions contained in this Ninth Amendment
<br /> shall prevail and be given superior effect and priority over any conflicting or inconsistent terms and
<br /> provisions contained in any other document or attachment, including but not limited to Attachment "A"
<br /> and Attachment"B".
