If the Contractor desires that any of <br />them be inspected elsewhere, the Engineer will inspect them at the place designated by the <br />Contractor, but all expenses, including a reasonable per diem to the Engineer, incurred in making <br />such inspection shall be borne by the Contractor, and shall be paid monthly or shall be deducted <br />from the monthly estimates by the City and paid to the City. An Inspection Bureau designated by <br />the Engineer shall do treated lumber testing at the mills. When the structure is ready for final <br />inspection, the Contractor shall so notify the Engineer in writing. After defects or omissions noted <br />during such final inspection are made good, the work will be accepted and final estimate <br />rendered. <br /> <br />It is expressly understood that the Contractor is in all respects an independent contractor for this <br />work, notwithstanding under certain conditions he is bound to follow the directions of the <br />Engineer, and is in no respect an agent, servant. or employee of the City. <br /> <br />11. Materials and Workmanship: <br /> <br />The Contractor shall provide the services of all workmen, mechanics, tradesmen and other <br />employees trained and skilled in their various occupations; and all materials except such as may <br />be specifically excluded in the drawings or specifications; and shall construct completely ready <br />for its intended purpose, the structure or parts thereof covered by the Contract, and the Plans and <br />Specifications. These Plans and Specifications intend to provide for the structure or parts thereon <br />under consideration to be fully completed and suitable in every feature for the purpose designed, <br />and the Contractor shall supply all materials and work incidental to, or described or implied as <br />incidental to, the construction included under this Contract, notwithstanding any omission in the <br />drawings or specifications. Wherever not explicitly described, materials and workmanship of <br />every kind shall be first class. The Contractor shall perform his work in proper sequence to the <br />work of other Contractors and to acts or operations of the City, and shall properly join his work to <br />existing or new construction. <br /> <br />12. Contract Securitv: <br /> <br />The Contractor agrees to execute and deliver simultaneously with the executed Contract. a <br />Contractor's Performance and Payment Bond on bond forms accepted by the City. The Bond(s), <br />in the amount of One Hundred Percent (100%) of the Contract amount may be in the form of a <br />Surety Bond written through a local surety bond agency, rated as to Management and Strength as <br />set forth on Section 100, Article 15 and the following Paragraphs: <br /> <br />On bond amounts of 500,000 or less, the provisions of Section 287.0935, Florida Statutes (2004, <br />as amended) shall be in effect and surety companies not otherwise qualifying with this paragraph <br />may optionally qualify by: <br /> <br />1. Providing evidence that the surety has twice the minimum surplus and capital required by <br />the Florida Insurance Code at the time the invitation to bid is issued, <br /> <br />2. Certifying that the surety is otherwise in compliance with the Florida Insurance Code, <br />and <br /> <br />3. Providing a copy of the currently valid Certificate of Authority issued by the United <br />States Department of the Treasury under ss. 3 1 U.S.c. 9304-9308. <br /> <br />General Specifications Oct. 2007 <br /> <br />Page 6 of 15 <br />
