<br />16. Le2al Restrictions, Permits and Traffic Provisions:
<br />
<br />The Contractor shall procure, at his own expense, all necessary licenses and permits and shall
<br />give due and adequate notices to those in control of all properties, which may be affected by his
<br />operations. The Contractor shall conform to all applicable laws, regulations, or ordinances with
<br />regard to labor employed, hours of work and his general operations.
<br />
<br />The Contractor shall so conduct his operations that he shall not close any thoroughfare nor
<br />interfere in any way with traffic on railway, highways, or on water, without the written consent of
<br />the proper authorities.
<br />
<br />17. Royalties on Patents
<br />
<br />All fees or royalties for any patented articles or operations of construction used in this structure or
<br />any part thereof of any materials, tools, implements, machinery, fixtures or anything used by the
<br />Contractor, shall as indicated in Section 700, paragraph 6.07.
<br />
<br />18. Liabilities, Dama2es and Accidents:
<br />
<br />The Contractor shall indemnify and hold harmless the City and its officers, employees, agents and
<br />instrumentalities from any and all liability, losses or damages, including attorney's fees and costs
<br />of defense. which the City or its officers, employees, agents, construction supervision
<br />representatives or instrumentalities may incur as a result of claims, demands, suits, causes of
<br />actions or proceedings of any kind or nature arising out of, relating to or resulting from the
<br />performance of the Agreement by the Contractor or its employees, agents, servants, partners,
<br />principals or subcontractors.
<br />
<br />The Contractor shall pay all claims and losses in connection therewith, and shall investigate and
<br />defend all claims, suits or actions of any kind or nature in the name of the City, where applicable.
<br />including appellate proceedings, and shall pay all costs, judgments, and attorney's fees which
<br />may issue thereon.
<br />
<br />The Contractor expressly understands and agrees that any insurance protection required by this
<br />Agreement or otherwise provided by the Contractor shall in no way limit the responsibility to
<br />indemnify, keep and save harmless and defend the City or its officers, employees, agents and
<br />instrumentalities as herein provided.
<br />
<br />The Contractor shall store materials and shall be responsible for and shall maintain partly or
<br />wholly finished work during the continuance of the Contract and until the final acceptance of the
<br />structure. If any materials or part of the work are lost, damaged, or destroyed by any cause or
<br />means whatsoever, the Contractor shall satisfactorily repair and replace the same at his own cost.
<br />
<br />The Contractor shall maintain suitable and sufficient guards and barriers, and at night, suitable
<br />and sufficient light for the prevention of accidents.
<br />
<br />19. Assi2nment of Contract:
<br />
<br />Neither the Contract, nor any part thereof, nor any monies due or to become due thereunder, may
<br />be assigned by the Contractor without the prior written approval of the City.
