<br />(7) Construction management and inspection; <br /> <br /> <br />(8) Surveying, soils and materials testing and removal of hazardous and <br /> <br /> <br />solid waste materials; <br /> <br /> <br />(9) Acquisition of capital equipment for parks; <br /> <br /> <br />(10) Repayment of any monies transferred or borrowed from any <br /> <br />budgetary fund of the City subsequent to the effective date of this <br /> <br /> <br />Ordinance, which were used to flind any of the growth-necessitated <br /> <br /> <br />Improvements as herein provided. Any funds that are borrowed shall <br /> <br /> <br />be spent only to mitigate the impact of new Development; <br /> <br />(11) Purchase ofland for additional parks and recreational facilities. <br /> <br /> <br />b. The seven and one half(7Y1%) percent general administrative cost portion of <br /> <br /> <br />the Impact Fee shall be deposited into the General Fund and shall be used to offset the costs <br /> <br />of administering the Impact Fee. <br /> <br />Section 8. Establishment of Fund. <br /> <br /> <br />Impact Fees collected pursuant to this Ordinance shall be accounted for in a Capital <br /> <br /> <br />Outlay Impact Fee Fund to be established by the City. <br /> <br /> <br />Section 9. Appeals of Administrative Decision. A decision of the City Manager may <br /> <br /> <br />be appealed by the F eepayer to the City Commission. If a F eepayer wishes to appeal, he/she shall first <br /> <br />file a Notice of Appeal within thirty (30) days after the earlier of; <br /> <br /> <br />a. Issuance of a written decision by the City Manager; or <br /> <br /> <br />b. Acceptance of payment by the Director of the City's Building, Zoning and <br /> <br /> <br />Planning Department of the parks impact fee. <br /> <br />0RD97-IS <br /> <br />-8- <br />
