<br />however, each Hauler shall within thirty (30) days of the passage of this Ordinance enter a <br />franchise agreement upon the terms and conditions set forth herein with the City and further <br />provided that the City shall be paid retroactively to the date of the passage of this Ordinance <br />in accordance with Section 1.12 hereinabove. <br /> <br />(b) Each Franchise awarded pursuant to this ordinance is subject to compliance <br />with all of the terms and conditions hereof except that the Franchisee eligible under <br />Sec. 1.14A may supplement the documentary materials and information which was <br />provided by Franchisee to secure a permit from Miami-Dade County to meet the <br />application requirements of this Ordinance, as determined by the City Manager. This <br />shall not waive the fee required by Section 1.03(g). <br /> <br />(c) The Franchise granted shall confer to Franchisee the right to operate upon the <br />public streets of City to provide the Solid Waste collection services in accordance <br />with the terms hereof. In the event that the Franchise is not executed or the fee not <br />paid hereunder, all rights, privileges and franchises heretofore granted by Miami-Dade <br />County for any area within the corporate limits of the City of Sunny Isles Beach <br />franchise area shall no longer be effective and it shall be unlawful for franchise to <br />continue activity as a solid waste hauler within Sunny Isles Beach. <br /> <br />Section 1.15 Restoration. <br /> <br />The Franchisee agrees to repair all property, public or private, altered or damaged by <br />it, its agents or employees in the performance of its services herein in as good or <br />better condition as it was before being damaged or altered. <br /> <br />Section 1.16 Compliance with Laws. <br /> <br />Franchisee shall conduct operations under this Ordinance in compliance with all <br />applicable laws. <br /> <br />Section 1.17 Services Provided. <br /> <br />Services provided by Franchisee shall comply with the City's ordinance governing the <br />time and frequency of Solid Waste Collection and removal. <br /> <br />Section 1.18 Office and Collection Hours. <br /> <br />(a) The Franchisee's office shall remain open Monday through Friday from 8:30 <br />a.m. to 5:00 p.m. for the purpose of handling complaints- and for that purpose, there <br />shall be maintained an adequate number of telephones and a responsible person in <br />charge during the hours specified above.
