<br />WHEREAS, the City Commission sitting as the local planning agency and the <br />Citizen's Planning Advisory Board and staff have worked diligently with their planning <br />consultant to undertake such preparation and have held workshops in conjunction with <br />the current district regulations pertaining particularly to those properties east of Collins <br />Avenue; and <br /> <br />WHEREAS, after much discussion and analysis, staff and the City s planning <br />consultants on the advice of council of the Land Planning Agency and the Citizen's <br />Planning Advisory Board, hereby amend Article XIX, RU-4A, Hotel Apartment House <br />District of the Code of Miami Dade County as adopted by Section 8.3 of the Charter of <br />the City of Sunny Isles Beach to more accurately reflect division for the City of Sunny <br />Isles Beach as shall be incorporated in the comp plan and as may be amended from time <br />to time; <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF <br />THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. The Code of Ordinances of the City of Sunny Isles Beach, Florida, is <br />hereby amended as follows: <br /> <br />( Underlining indicates proposed additions to the current district regulations, and <br /> <br />strike throl:lgh indicates proposed deletions from the current regulations) <br /> <br />ARTICLE XIX, RU-4A, HOTEL APARTMENT HOUSE DISTRICT <br /> <br />Sec. 33-217. Uses permitted. <br /> <br />No land, body of water or structure shall be used, or permitted to be used~ and no <br /> <br />structure shall be hereafter erected, constructed, moved or reconstructed, structurally <br /> <br />altered or maintained for any purpose in an RU-4A District which is designed, arranged, <br /> <br />or intended to be used or occupied for any purpose, except for one of the following uses: <br /> <br />(1) Those uses permitted in the RU-l, RU-2, RU IM(a), RU IM(b), RU 3 <br /> <br />8:REl RU TH Districts subject only to the requirements, limitations and <br /> <br />099-63 RU-4A Article XIX Amendment 3/5/99. <br /> <br />Page 2 of 42 <br />
