<br />ORDINANCE NO. 99- ~ ~ <br /> <br />AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, PROVIDING THE TERMS AND CONDITIONS <br />FOR THE OPERATION OF CABLE TELEVISION SYSTEMS <br />AND THE APPLICATION, PROCEDURES AND <br />REQUIREMENTS RELATING TO THE GRANT OF <br />FRANCHISES FOR THE CONSTRUCTION, INSTALLATION, <br />OPERATION AND MAINTENANCE OF CABLE <br />TELEVISION SYSTEMS, EQUIPMENT AND FACILITIES IN, <br />ON, ACROSS, ABOVE OR THAT IN ANY MANNER <br />WHATSOEVER USE THE CITY'S PUBLIC RIGHTS-OF- <br />WAYS AND TO ENSURE THAT USE OF THE CITY'S <br />PUBLIC RIGHTS-OF-W AYS IS IN THE PUBLIC INTEREST <br />AND IN CONFORMANCE WITH APPLICABLE LAW; <br />PROVIDING FOR THE REPEAL OF SECTION 8AA OF THE <br />CODE OF MIAMI-DADE COUNTY AS ADOPTED BY <br />SECTION 8.3 OF THE CHARTER OF THE CITY OF SUNNY <br />ISLES BEACH AS ITS OWN ORDINANCE; PROVIDING FOR <br />SEVERABILITY; PROVIDING FORAN EFFECTIVE DATE. <br /> <br />WHEREAS, effective with the adoption ofthe Charter of the City of Sunny Isles Beach (the <br /> <br />"Charter") on June 16, 1997, the City of Sunny Isles Beach, Florida was created as a municipal <br /> <br />corporation pursuant to the Constitution of the State of Florida and the Home Rule Charter of <br /> <br />Metropolitan Dade County; and <br /> <br />WHEREAS, Section 8.3 of the Charter adopted the Code of Miami-Dade County as its own, <br /> <br />including Section 8AA, but the City Commission has now determined it is in the public interest of <br /> <br />the City of Sunny Isles Beach (hereinafter referred to as the "City of Sunny Isles Beach" or the <br /> <br />"City") to franchise the operation of one or more cable television systems in the City on its own <br /> <br />terms; and <br /> <br />WHEREAS, one or more cable operators are occupying the City's public rights ofways and <br /> <br />operating cable systems pursuant to licenses granted by Metropolitan Dade County; and <br /> <br />Cable Ordinance <br /> <br />-1- <br />
