<br />(7) Other societal interests as are generally considered in cable <br />television franchising; and <br /> <br />(8) Such other additional matters, both procedural and <br />substantive, as the City may in its sole discretion determine <br />to be relevant, including but not limited to the extent to which <br />the proposal of the applicant will meet the anticipated cable <br />related needs and interests of the community and serve the <br />public interest. Evaluation by the City shall not be based on <br />the content of the programming the applicant proposes to <br />provide. <br /> <br />(b) The City may grant a franchise for a period not to exceed 15 years. <br /> <br />(c) The City may make the grant of a franchise conditioned upon the completion of <br />construction within a reasonably prescribed time or upon the performance and fulfillment of specific <br />terms, which are to be set forth in the franchise agreement specifying that failure to comply with the <br />conditions will cause the franchise to become null and void without further action by the City. <br /> <br />(d) Following at least ten days' notice to the applicant, the City shall hold a public hearing <br />to consider an application or applications. The applicant(s) shall be notified of the hearing and shall <br />be given an opportunity to be heard. Based upon the application(s), the testimony presented at the <br />public hearing, any recommendations of the City Manager or staff, and any other information <br />relevant to the application( s), the City shall decide by resolution whether to grant or deny a franchise <br />application(s) and decide the terms and conditions of any franchise(s) granted. <br /> <br />( e) If the City grants a franchise the franchisee shall file an acceptance of the franchise <br />accompanied by any and all bonds, certificates of insurance or other obligations as required in a <br />franchise agreement within 45 calendar days from the date of the City resolution approving the <br />franchise agreement. This period may be extended for good cause by the City. If acceptance is not <br />filed with the City within 45 calendar days from the date of the City resolution, or if the period is <br />not extended by the City, the franchise grant will be null and void without further action by the City. <br />The City may, at its option, grant franchisee a short term extension(s). The grant of such a short <br />term extension(s) will not confer on franchisee the right to an automatic acceptance, transfer, <br />modification or renewal. <br /> <br />(f) The grant, renewal, modification, or transfer of a franchise may be subject to a processing <br />fee in an amount not to exceed the reasonable and justifiable out-of-pocket costs incurred by the City <br />in considering the application, including but not limited to consulting, advertising and legal costs <br />and fees, less the amount of the filing fee set pursuant to Section 7 up to an amount not to exceed <br />$50,000.00. Within 30 calendar days from the date of the resolution approving or denying the <br />franchise agreement by the City Commission, the City shall notify the franchisee ofthe amount of <br />any processing fee and its method of calculation.
