<br />(b) Any person shall notify the City in writing within 30 calendar days of the passage ofthis <br />article, or any subsequent amendment thereof, of: <br /> <br />(1) Any provision which it believes should not be applicable to it. <br /> <br />(2) The reason for each such claim of non-applicability. <br /> <br />(c) Failure to notify the City as provided in subsection (b) of this section shall constitute a <br />waiver of any right to object. <br /> <br />Sec. 29. <br /> <br />Municipal cable system ownership authorized. <br /> <br />(a) To the full extent permitted by law, the City may acquire, construct, own and/or operate <br />a cable system. <br /> <br />(b) Nothing in this article shall be construed to limit in any way the ability or authority of the <br />City to acquire, construct, own and/or operate a cable system to the full extent permitted by law. <br /> <br />Sec. 30. <br /> <br />Violations of article. <br /> <br />(a) Whenever the City finds that a person has allegedly violated any provision of this article, <br />not otherwise described in Section 16 herein, such person shall have 30 days subsequent to receipt <br />of notice to correct the violation. If after 30 days, the recipient has failed to correct the alleged <br />violation, or commence curing to a substantial extent and to the satisfaction of the City, the City <br />shall determine if the person has committed a violation and shall make written findings of fact. If <br />a violation is found, the person shall pay to the City $500.00 per day, or any part thereof for each <br />day each violation occurs or continues. The City reserves the right to withdraw said payments from <br />the security fund upon three (3) days' written notice to the franchisee. It is the intent of the City to <br />impose the above discussed fines as a reasonable estimate ofthe damages suffered by the City and/or <br />its subscribers, whether actual or potential, and may include without limitation, increased costs of <br />administration and other damages difficult to measure. <br /> <br />(b) The City hereby reserves any and all rights to require that a person remove its equipment <br />and facilities from the City's public rights-of-way where the City has determined and issued a <br />written decision finding that the damages suffered by the City or its residents cannot be remedied <br />by any reasonable means other than by termination or revocation of a person's rights to use the <br />City's rights-of-way. <br /> <br />Sec. 31. <br /> <br />Enforcement remedies. <br /> <br />(a) In addition to any other remedies available at law or equity or provided herein under <br />Section 16, the City may apply anyone or combination of the following remedies in the event a <br /> <br />Cable Ordinance <br /> <br />-41- <br />
