<br />failure by affidavit from the Code Enforcement Officer. Failure of the named <br />Violator to appeal the decision of the Code Enforcement Officer within the <br />prescribed time period shall constitute a waiver of the Violator's right to <br />administrative hearing before the Special Master. A waiver of the right to <br />administrative hearing shall be treated as an admission of the violation, and <br />penalties may be assessed accordingly. <br /> <br />Section 6. <br /> <br />Section 10 entitled "Schedulin~ and Conduct of Hearine" paragraph (A) is <br />amended as follows: <br /> <br />(A) Upon receipt of a named Violator's timely request for an administrative <br />hearing or a written hearing request from the Code Enforcement Officer as <br />provided for in Section =I- I, the City Manager, in consultation with the <br />Special Master, shall set the matter down for hearing on the next regularly <br />scheduled hearing date or as soon thereafter as practicable. <br /> <br />Section 7. <br /> <br />Applicability. <br /> <br />Except as otherwise specifically amended herein, all other terms and codes of Ordinance 98- <br />21 and 98-57 shall remain in full force and effect. <br /> <br />Section 8. <br /> <br />Repeal of Conflict Provisions. <br /> <br />All ordinances or parts of ordinances in conflict herewith be and the same are hereby <br />repealed. <br /> <br />Section 9. <br /> <br />Severability. <br /> <br />The provisions of this Ordinance are declared to be severable and if any section, sentence, <br />clause or phrase of this Ordinance shall for any reason be held up to be invalid or <br />unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />Section 10. Codification. <br /> <br />It is the intention of the City Commission, and it is hereby ordained that the provisions of <br />this Ordinance shall become and made a part of the City of Sunny Isles Beach Code. <br />Sections of this Ordinance may be renumbered or re-Iettered to accomplish such intentions, <br />and that the word "Ordinance" shall be changed to "Section" or other appropriate word. <br /> <br />Section 11. Effective Date. <br /> <br />This Ordinance shall take effective ten (10) days after adoption on second reading. <br /> <br />098-21 Code Enf. Amendment <br /> <br />6 <br />
