<br />immediate area surrounding the garbage can litter, garbage, and trash free at <br />all times. <br /> <br />It shall be a violation of the Code of Ordinances to allow the garbage can to <br />be filled to over capacity so that the lid is prevented from closing. <br /> <br />(E) <br />(F) <br /> <br />Garbage cans shall be maintained in good repair. <br /> <br />The location of a garbage can on said property, and behind said building line <br />shall not be so located as to cause a nuisance to the surrounding properties. <br /> <br />Section 2. <br /> <br />Penalties for Violation. <br /> <br />Any person who violates any section of this code shall be subject to the issuance of a civil <br />penalty as follows: <br /> <br />1 st Offence <br /> <br />$ 25.00 <br /> <br />2nd Offence <br /> <br />$ 50.00 <br /> <br />3rd Offence <br /> <br />$100.00 <br /> <br />These civil penalties shall be issued after the appropriate warning period and in accordance <br />with Ordinance No.'s 98-21,98-57, & 99-71. <br /> <br />Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed <br />to the extent of such conflict <br /> <br />Section 4. If any clause, section or other part of this ordinance shall be held by any court <br />of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid <br />part shall be considered as eliminated and shall in no way affect the validity of the remaining <br />portions of this ordinance. <br /> <br />Section 5. This ordinance shall become effective as provided by law. Enforcement will <br />commence sixty (60) calendar days after adoption of this ordinance so that the City may have <br />an opportunity to disseminate information to the general public regarding the requirements of <br />this ordinance. <br /> <br />PASSED AND ADOPTED on first reading this 15th day of June, 2000. <br />PASSED AND ADOPTED on second reading this I I +.b day ofJt.dy, 2000. <br /> <br />Ord. 2000-96 <br /> <br />2 <br />
