<br />(E) Failure to follow the ~rotest procedures set forth herein shall automatically nullify any protest <br />or claim brought by an aggrieved bidder. offeror or contractor. <br /> <br />ARTICLE 9. ETHICS IN PUBLIC CONTRACTING <br /> <br />In addition to all ethical rules and guidelines set forth by the Commission on Ethics and the <br />Miami-Dade County Code. as applicable to the City of Sunny Isles Beach and the State of Florida. <br />the City Manager may impose anyone or more of the following sanctions on a City Employee for <br />violations of ethical standards set forth by Miami-Dade County or the State of Florida including. but <br />not limited to: oral or written warnings or reprimands. suspension with or without ~ay for specified <br />periods of time or termination of employment. For non-employees. for violations of ethical <br />standards. the City Commission may terminate any contract with the City of Sunny Isles Beach. <br /> <br />ARTICLE 10. REPEAL OF CONFLICTING PROVISIONS. <br /> <br />All provisions ofthe Code of Metropolitan Dade County as made applicable to the City by <br />Article vm, Sections 8.3 of the City Charter and Ordinance 97-10 which are in conflict with this <br />Ordinance are hereby repealed. <br /> <br />ARTICLE 11. SEVERABILITY. <br /> <br />The provisions of this Ordinance are declared to be severable and if any section, sentence, <br />clause or phrase ofthis Ordinance shall for any reason be held to be invalid or unconstitutional, such <br />decision shall not affect the validity ofthe remaining sections, sentences, clauses, and phrases of this <br />Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall <br />stand notwithstanding the invalidity of any part. <br /> <br />ARTICLE 12. INCLUSION IN THE CODE. <br /> <br />It is the intention ofthe City Commission, and it is hereby ordained that the provisions of this <br />Ordinance shall become and made a part ofthe City of Sunny Isles Beach Code; that the sections of <br />this Ordinance may be renumbered or re-Iettered to accomplish such intentions; and that the word <br />"Ordinance" shall be changed to "Section" or other appropriate word. <br /> <br />ARTICLE 13. EFFECTIVE DATE. <br /> <br />This Ordinance shall be effective upon adoption on second reading. <br /> <br />SECTION 12. TRANSITION PR-OVISION. <br /> <br />Until a City Manager is employed by the City ofS1:lflIl)' Isles Beach, the City Commission or <br />its desigaee shall be the chief pl:lfchasing agent of the City.
