<br />provided however that if said view corridor is wider than the side setback as described in <br /> <br />section 33-220(3)(b) then, in that event, such view corridor shall be located on the North <br /> <br />side of the property unless at the discretion of the City Manager or his / her designee, a <br /> <br />public purpose would be served by placing the view corridor on the south side, if the <br /> <br />proposed development will create wider open space corridors and greater building <br /> <br />setbacks. Properties donated or dedicated to the City and accepted by the City <br /> <br />Commission or encumbered with a public access easement that lies within the required <br /> <br />view corridor areas shall continue to be credited toward this requirement. The purpose of <br /> <br />said dedications/easements is to encourage views of the bay or ocean and features such as <br /> <br />walkways, public parking areas, fishing piers, gazebos, art objects and other similar <br /> <br />amenities. A floor area ratio bonus shall be given for developments abutting the bay or <br /> <br />ocean where said dedications/easements are granted pursuant to the provisions of Section <br /> <br />33-222 <br /> <br />Sec. 33-220.2. Maximum building obstruction of views of the ocean. <br /> <br />In order to preserve views of the ocean for properties that do not directly abut the <br /> <br />ocean, no more than fifty percent of the width of the site that abuts the ocean may be <br /> <br />obstructed by buildings exceeding two stories or elevation twenty (20) feet in height <br /> <br />above grade M.S.L., except as set forth in Sec 33-220(4) herein.
