<br />(2) To be habitually truant from school, while subject to compulsory school <br />attendance, despite reasonable efforts to remedy the situation and through <br />voluntary participation by the child's parents or legal custodians and by the <br />child in family mediation, services and treatment offered by the State of <br />Florida Department of Health and Rehabilitative Services; or <br /> <br />(3) To have persistently disobeyed the reasonable and lawful demands of his <br />parents or legal custodians and to be beyond their control despite efforts by <br />the child's parents or legal custodians and appropriate agencies to remedy <br />the conditions contributing to the behavior. Reasonable efforts may include <br />such things as good faith participation in family or individual counseling. <br /> <br />(38) Depth of lot. The depth of a lot is the depth between its mean front street line and its <br />mean rear line. <br /> <br />(38-1) Development disability means a disorder or syndrome which is attributable to retardation, <br />cerebral palsy, autism, epilepsy, or spina bifida and which constitutes a substantial <br />handicap that can reasonably be expected to continue indefinitely. <br /> <br />(39) Director. The word "Director" shall mean the Director of the Department of Planning and <br />Zoning or designee, unless the context dearly indicates otherwise. <br /> <br />(40) Dog kennel. The keeping of any dog or dogs, regardless of number, for sale, breeding, <br />boarding or treatment purposes, except in a dog hospital, dog beauty parlor or pet shop, <br />as permitted by law, or the keeping of five (5) or more dogs, six (6) months or older, on <br />premises used for residential purposes, or the keeping of more than one (1) dog on vacant <br />property or on property used for business or commercial purposes, shall constitute a <br />kennel. <br /> <br />(40.1) Domestic violence means any assault, battery, sexual assault, sexual battery or any <br />criminal offense resulting in physical injury or death of one (1) family or household <br />member by another who is or was residing in the same single dwelling unit. <br /> <br />(40.2) Domestic violence center means a facility that provides shelter, counseling and referral <br />services to victims of domestic violence. <br /> <br />(41) Dwelling, one family. A private residence building used or intended to be used as a home <br />or residence in which all living rooms are accessible to each other from within the building <br />and in which the use and management of all sleeping quarters, all appliances for sanitation, <br />cooking, ventilating, heating or lighting are designed for the use of one (1) family only. <br /> <br />(42) Dwelling, duplex. A residence building designed for, or used as the separate homes or <br />residences of two (2) separate and distinct families, but having the appearance of a single <br /> <br />02000 - Amendment to section 33-1 <br /> <br />7 <br />
