<br />2. The Building Official shall, within 30 days of detecting such a deficiency, notify <br />the feepayer, the contractor, and the property owner by certified mail, return <br />receipt requested, that: <br /> <br />a. an additional impact fee amount is due immediately upon receipt of <br />said letter. <br /> <br />b. a permit or CO will not be issued until the amount is paid and if not <br />paid within 15 days, the Building Department shall have authority to <br />stop all construction on the site of said building permit until the <br />payment is received. <br /> <br />3. Prior to the expiration of one year from the date a final Certificate of Occupancy <br />is issued for which the required impact fees have not been paid, or have not been <br />paid in full, the City shall, where authorized by the applicable City ordinances, <br />have authority to file a lien against the real property until the required impact fees, <br />together with additional charges allowed by such applicable City ordinances, have <br />been paid. <br /> <br />Section 12. Severability. <br /> <br />A. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any <br />reason, held invalid or unconstitutional by any court of competent jurisdiction, such section, <br />subsection, sentence, clause, phrase or portion of this Ordinance shall be deemed to be a separate, <br />distinct and independent provision and such holding shall not affect the validity of the remaining <br />provisions of this Ordinance nor impair or nullify the remainder of this Ordinance which shall <br />continue in full force and effect. <br /> <br />B. If the application of any provision of this Ordinance to any new development is declared <br />to be invalid by a decision of any court of competent jurisdiction, the intent of the Commission is <br />that such decision shall be limited only to the specific new development expressly involved in the <br />controversy, action or proceeding in which such decision of invalidity was rendered. Such <br />decision shall not affect, impair, or nullify this Ordinance as a whole or the application of any <br />provision of this Ordinance to any other new development. <br /> <br />Section 13. Inclusion in the Code. It is the intention of the City Commission and it is hereby <br />ordained that the provisions of this Ordinance be included and incorporated into the Code of <br />Ordinances of the City of Sunny Isles Beach as an addition thereto and the sections of this <br />Ordinance may be renumbered to conform to any uniformed numbering system. <br /> <br />Section 14. Effective Date.
