<br />CODE ENFORCEMENT <br /> <br />(b) For violations of Chapter 5 of the County <br />Code, the violator or the County may seek to <br />overturn the order of a hearing officer by making <br />application to Miami-Dade County Court for a <br />trial de novo on the merits. Such application shall <br />be filed within thirty (30) calendar days of the <br />issuance of the order sought to be overturned. A <br />violator shall have the right to a de novo proceed- <br />ing provided that all administrative remedies <br />have been exhausted. Failure to make such appli- <br />cation within the prescribed thirty-day period <br />shall render the findings of the hearing officer <br />conclusive, binding and final. All findings of the <br />hearing officer shall be admissible evidence at <br />any de novo proceeding held pursuant to this <br />section. <br /> <br />(c) Unless the findings of the hearing officer <br />are overturned in a proceeding held pursuant to <br />Section SCC-8(a), all findings of the hearing of- <br />ficer shall be admissible in any proceeding to <br />coUect unpaid penalties. <br />(Ord. Provisions contained herein are <br />supplemental; ,eneral penalty <br />for failure to correct violations. <br /> <br />(1) Nothing contained in this chapter shall <br />prohibit Miami-Dade County from enforcing its <br />Code by any other means. The enforcement pro- <br />cedures outlined herein are cumulative to all <br />others and shall not be deemed to be prerequisites <br />to filing suit for the enforcement of any Section of <br />this Code. <br /> <br />(2) It shall be unlawful for a named violator <br />found guilty of a code violation pursuant to Sec- <br />tion 8CC-S(c) or Section SCC-6 to fail to correct <br />the violation as set forth in the uniform civil <br />violation notice and said failure shall be a sepa- <br />rate offense punishable as set forth in Section 1-5 <br />of the Code of Miami-Dade County, Florida. <br />(Ord. Schedule of civil penalties. <br /> <br />The following table shows the sections of this Code, as they may be amended from time to time, which <br />may be enforced pursuant to the provisions of this chapter; and the dollar amount of civil penalty for the <br />violation of these sections as they may be amended. <br /> <br />The "descriptions of violations" below are for informational purposes only and are not meant to limit <br />or define the nature of the violations or the subject matter of the listed Code sections, except to the extent <br />that different types of violations of the same Code section may carry different civil penalties. For each <br />Code section listed in the schedule of civil penalties, the entirety of that section may be enforced by the <br />mechanism provided in this Chapter ace, regardless of whether all acttvities proscribed or required <br />within that particular section are described in the "Description of Violation" column.
