<br />ORDINANCE NO. 2001-B.3 <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, ESTABLISHING APPLICABILITY <br />AND SPEED LIMITS ON LOCAL STREETS AND ALLEYS WITHIN <br />THE CORPORATE LIMITS OF THE CITY OF SUNNY ISLES BEACH, <br />ADOPTING DEFINITIONS; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE <br />CODE; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, Chapter 316, Florida Statutes, State Uniform Traffic Control, recognizes <br />there are conditions which may require municipalities to pass traffic ordinances for the <br />regulation of municipal traffic; and <br /> <br />WHEREAS, Section 30-299 of the Code of Miami-Dade County recognizes that <br />municipalities may establish a maximum speed of 30 miles per hour in the corporate limits of a <br />municipality, altering such speeds both as the maximum and minimum, after investigation to <br />determine such a change is reasonable and in conformity to the criteria promulgated by the <br />Department of Transportation; and <br /> <br />WHEREAS, the City of Sunny Isles Beach has conducted such an investigation and <br />come to certain conclusions which are reflected in this ordinance; <br /> <br />~". <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Definitions. The following words and phrases when used in this Ordinance, <br />except where the context clearly indicates a different meaning, shall supplement the definitions <br />contained in Florida Statutes 9316.003: <br /> <br />a. Alley means every street or way within a block set apart for public use, <br />vehicular traffic and local convenience, except foot paths. <br /> <br />b. City Manager shall mean the Manager of the City of Sunny Isles Beach or <br />hislher authorized designee. <br /> <br />Section 2. Applicabilitv. This Ordinance shall apply to every residential street, alley, <br />sidewalk, driveway, parking area, park area and every other way within this municipality, <br />including without in any way restricting the generality of the foregoing, to any area which is <br />privately owned and to which the public is invited or the use of which is or may be afforded to <br />the public by acquiescence and without invitation. <br /> <br />Section 3. <br /> <br />Speed Limits. <br /> <br />a.
