<br />SECTION 9.10. Captions. The captions or headings in this Loan Agreement are for <br />convenience only and in'no way define, limit or describe the scope or intent of any provisions of <br />sections of this Loan Agreement. <br /> <br />SECTION 9.11. No Pecuniary Liability of Council. No provision, covenant or agreement <br />contained in this Loan Agreement, or any obligation herein imposed upon the Council, or the breach <br />thereof, shall constitute an indebtedness or liability of the State or any political subdivision or <br />municipal corporation of the State or any public corporation or governmental agency existing under <br />the laws thereof other than the Council. In making the agreements, provisions and covenants set <br />forth in this Loan Agreement, the Council has not obligated itself except with respect to the <br />application of the revenues, income and all other property as derived herefrom, as hereinabove <br />provided. <br /> <br />SECTION 9.12. Payments Due on Holidays. With the exception of Basic Payments, ifthe <br />date for making any payment or the last date for performance of any act or the exercise of any right, <br />as provided in this Loan Agreement, shall be other than on a Business Day, such payments may be <br />made or act performed or right exercised on the next succeeding Business Day with the same force <br />and effect as if done on the nominal date provided in this Loan Agreement. <br /> <br />SECTION 9.13. Calculations. Interest shall be computed on the basis of a 360-day year of <br />twelve 30-day months. <br /> <br />SECTION 9.14. Time of Payment. Any Loan Repayment or other payment hereunder <br />which is received by the Trustee or Council after 2:00 p.m. (New York time) on any day shall be <br />deemed received on the following Business Day. <br /> <br />[Remainder of page intentionally left blank] <br /> <br />30 <br />
