<br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br /> <br />CITY OF SUNNY ISLES BEACH, FLORIDA, THAT: <br /> <br /> <br />Section 1. Puroose. It is the purpose of this ordinance to provide a framework for the <br /> <br />operation of the City during natural or man-made disasters. <br /> <br />Section 2. Dermitions. <br /> <br />As used in this Article: <br /> <br />(A) " Emergency" shall mean a condition which threatens or adversely affects the <br /> <br />public health, safety, general welfare or security and which is or threatens to be beyond the <br /> <br />control of those public and private agencies normally responsible for the management of such a <br /> <br />condition, resulting from and act or imminent threatened act of war, riot, terrorism, mob or other <br /> <br />acts of violence; from conflagration, explosion, hazardous materials incident or release; from a <br /> <br />weather event such as a flood, hurricane or tornado; from a disruption in the City's utility, or <br /> <br />other utility system; or from any other cause, reason, condition or circumstance. <br /> <br />(B) " Average Retail Price" shall mean the price at retail for merchandise, goods or <br /> <br />services at which similar merchandise, goods or services were being sold prior to the public <br /> <br />emergency being declared. <br /> <br />(C) " City Manager" shall mean the City Manager of the City of Sunny Isles Beach or <br /> <br />a designee appointed by the City Commission, if the City Manager is not available. <br /> <br />Section 3. ADDlieabilitv of Provisions.
