<br />"Apartment Hotel" shall mean a building containing apartments which may have one or <br />more bedrooms ("lockout rooms") that may be accessed and occupied independent <br />(separate keyed entry) of the primary apartment space and each apartment including <br />any lockout rooms and all facilities and outdoor areas used in common by all tenants <br />are owned, administered and maintained by a corporation created pursuant to Florida <br />Statutes. No more than five percent (5%) of the apartment units may be occupied for <br />more than six (6) months by the same owner, lessee or Sublessee. The owner, lessee <br />or sublessee may occupy the remaining apartments for extended-stay periods of up to <br />six months duration during any twelve-month period. The apartment and any <br />appurtenant lockout bedroom(s) may be rented collectively or separately on a <br />transient basis for periods of one (1) to one hundred eighty (180) days providing <br />central reservation service, maid, linen or other room services customarily provided <br />by hotel management and operations. A management company shall manage the <br />building at all times and shall submit to the City's Zoning Department an annual <br />report delineating lease and rental activities for each unit within the building by June <br />30th of each year. Failure to file this report shall resuh in a fine of$500 and an audit <br />by the City. <br /> <br />"Application for Development Approval" shall mean a completed application for approval <br />of a proposed use or structure and for issuance of a development order, including, but <br />not limited to, applications for approval of: plats, conditional uses, re-zonings, site <br />plans and variances, etc. <br /> <br />"Area of Special Flood HaZ/lrd" shall mean that area within a community in the tOO-year <br />floodplain. <br /> <br />"Assisted Living FacUity (ALF)" shall mean any facility, licensed by the State of Florida, <br />which undertakes to provide for a period exceeding 24 hours, housing, food service, <br />personal services, limited nursing services or limited mental health services to <br />unrelated persons. <br /> <br />"Attached Residentiaf' shall mean a building with a common roof that houses more than <br />one dwelling unit, each on its own lot, with a common or abutting wall shared for at <br />least fifty percent of the length of the side of the dwelling. <br /> <br />"Attached Commercial" shall mean a building with a common roof that houses more than <br />one commercial tenant. <br /> <br />city of Sunny Isles Beach-Land Development Regulations <br />Adopted December 10, 2002 <br /> <br />CHAPTER 2 - Definitions" Rules of Construction 200- 4 <br />
