<br />Section 503: Conditional Uses. <br /> <br />503.1 Pwpose. Conditional uses are generally compatible with the other land <br />uses permitted in a zoning district but, because of their unique <br />characteristics or potential impacts on the surrounding neighborhood and <br />the City as a whole, require individual review as to their location, design, <br />configuration, and/or operation for the particular use at the particular <br />location proposed, as well as the imposition of individualized conditions in <br />order to ensure that the use is compatible with the surrounding <br />neighborhoods and appropriate at a particular location. <br /> <br />503.2 Applications Requirements. No use designated, as a conditional use shall <br />be established until after such use has received approval under the <br />provisions of this section and has received all other permits required by <br />these LDRs. An application for conditional use approval shall be filed with <br />the Department of Zoning, Planning and Building on forms provided and <br />run concurrent with site plan approval. The application shall include: <br /> <br />a) A site plan, meeting the technical requirements for a final site plan. <br /> <br />b) An application fee, as may be established from time to time by the <br />City Commission. <br /> <br />c) A written and graphic summary of the proposed project. <br /> <br />d) Ownership affidavit and owner's sworn to consent, if applicable. <br /> <br />e) Current certified survey. <br /> <br />503.3 General Standards of Review. In addition to the standards set forth in these <br />LDRs for the particular use, all proposed conditional uses should meet each <br />of the following standards: <br /> <br />a) The proposed use shall be consistent with the Comprehensive Plan; <br /> <br />b) The establishment, maintenance or operation of the proposed use shall <br />not be detrimental to or endanger the public health, safety, or general <br />welfare; <br /> <br />c) The proposed use shall be consistent with the community character of <br />the immediate neighborhood of the proposed use; <br /> <br />d) Utilities, roadway capacity, drainage, and other necessary public <br />facilities, including police, fire and emergency services, shall exist at <br />the City's adopted levels of service, or will be available concurrent <br />with demand as provided for in the requirements of theses LDRs; <br /> <br />City of Sunny Isles Beach-Land Development Regulations <br />Adopted December 10,2002 <br /> <br />CHAPTER 5 - Development Review 500-6 <br />
