<br />Section 512: Appeals. <br /> <br />512.1 PurJlOses and Applicability. This section is intended to provide for appeals <br />from the decisions of decision-making and administrative bodies having <br />development approval authority under the LDRs or from any written order, <br />requirement, decision, determination, or interpretation made by an <br />administrative official or the City Commission in the enforcement of these <br />regulations. Any person aggrieved by a decision made by an administrative <br />official or the City Commission may file an appeal under this section. <br /> <br />512.2 Appeal of Administrative Decisions. All appeals of administrative actions <br />shall be made to the City Manager, within fourteen (14) days of the <br />administrative decision. The City Manager shall then determine within <br />fourteen (14) days whether to refer the matter back to the administrative <br />official or to reject the appeal and shall notify the applicant, in writing, who <br />may then appeal to the City Commission for final action. Any appeal to the <br />City Commission shall be in writing and filed with the City Clerk within <br />thirty-days (30) of the date of the City Manager's determination. The City <br />Clerk shall schedule a public hearing regarding the appeal within sixty- <br />days (60). <br /> <br />512.3 Action by the City Commission. A public hearing shall be held by the City <br />Commission to consider the application. The applicant shall be advised in <br />writing of the hearing date and time. The City Commission shall review the <br />application, the report and recommendation of the administration and <br />consider the evidence and testimony provided at the hearing. After the <br />public hearing is held, the City Commission shall issue a written decision <br />and order granting the relief sought in the application, with or without <br />conditions, or denying the appeal. <br /> <br />512.4 Appeal of an Order of the City Commission. Appeals from any decision of <br />the City Commission made pursuant to the LDRs shall be in accordance <br />with Rule 9.190, Florida Rules of Appellate Procedure. <br /> <br />City of Sunny Isles Beach-Land Development Regulations <br />Adopted December 10, 2002 <br /> <br />CHAPTER 5 - Development Review 500-37 <br />
