<br />ARTICLE VI. <br /> <br />V ARlANCE PROCEDURES. <br /> <br />Section A. <br /> <br />DESIGNATION OF V ARlANCE AND APPEALS BOARD. <br /> <br />m(}..) The City Commission shall hear and decide appeals and requests for variances from the <br />requirements of this Ordinance. <br /> <br />Section B. <br /> <br />DUTIES. <br /> <br />ill tBj The Commission shall hear and decide appeals when it is alleged an error in any requirement, <br />decision or determination is made by the Building Official in enforcement or administration ofthis <br />Ordinance. <br /> <br />Section C. <br /> <br />APPEAL. <br /> <br />ill Any person or entity aggrieved by the decision of the City Commission may appeal such <br />decision to the Circuit Court. pursuant to the Florida Rules of Civil Procedure. <br /> <br />ill (C) VariaRees from. this OrdinaRee m.ay be issued for the repair or rehabilitation of historie <br />stnietures upon a cleterm.ination that the proposed repair or rehabilitation will not preelude the <br />stmemre's contiIffied designation as aR "historic stmeture" and the variance is the minimwn to <br />preserve the historie charaeter and aesign of the struemre. <br /> <br />Section D. <br /> <br />V ARlANCE PROCEDURES. <br /> <br />ill tQt In passing upon such applications, the Commission shall consider all technical evaluations, <br />all relevant factors, all standards specified in other sections of this Ordinance, and the following: <br /> <br />W-(I) The danger that materials may be swept onto other lands to the injury of <br />others; <br /> <br />fltlJ2) The danger to life and property due to flooding or erosion damage; <br /> <br />~(3) The susceptibility of the proposed facility and its contents to flood damage <br />and the effect of such damage on the individual owner; <br /> <br />@..(4) The importance of the services provided by the proposed facility to the <br />community; <br /> <br />~(5) The necessity of a facility to a waterfront location, in the case of a <br />functionally dependent use; <br /> <br />ill (6) The availability of alternative 10cations, not subject to flooding or erosion <br />damage, for the proposed use; <br /> <br />Flood Damage Prevention Ord, <br />Legislation/Ordinances!
