<br />ORDINANCE NO. 2005-~'3 <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA AMENDING <br />SECTION 265-46 OF THE LAND DEVELOPMENT <br />REGULATIONS RELATING TO PARKING <br />REGULATIONS TO PROHIBIT PARKING OF VEHICLES <br />ON FRONT LAWNS IN RESIDENTIAL DISTRICTS AND <br />TO PROHIBIT PARKING OF VEHICLES ON PUBLICLY <br />MAINTAINED LAWNS AND LANDSCAPED AREAS; <br />PROVIDING FOR AN EXCEPTION; PROVIDING FOR <br />ENFORCEMENT; PROVIDING FOR PENAL TIES; <br />PROVIDING FOR SEVERABILITY; PROVIDING FOR <br />INCLUSION IN THE CODE; PROVIDING FOR <br />REPEALER; AND PROVIDING FOR AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, in an effort to prevent blight in the City, the City Commission wishes to <br />prohibit the parking of vehicles on front lawns and lawns maintained by the City; and <br /> <br />WHEREAS, the City Commission believes that the parking of vehicles on lawns are <br />contrary to the beautification policies adopted by the Commission. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Section 265-46 of the Code of the City of Sunny Isles Beach is amended to add <br />new subsections to read as follows: <br /> <br />15. Residential Districts. No vehicles shall be permitted to park <br />permanently f{)r a 24 hour period on front or side lawns of any <br />property located in any residential district. Vehicles shall park <br />upon an improved driveway or improved parking pad. For the <br />purposes of this section, "improved" means surfaced with <br />concrete, asphalt, gravel on top of hard surface, or any other <br />material commonly used for the parking of vehicles, but not <br />including grass or dirt. All other provisions of the City code <br />relating to landscape requirements for residential property shall <br />not be affected by this section. This section shall not apply to <br />special events involving family or social gathering. provided <br />such events do not occur more frequently than onee a week. <br /> <br />16. Publiclv Maintained Lawns. No vehicle shall be permitted to <br />park on lawns and landscape areas maintained by the City or <br />any other governmental entity unless permission is granted by <br />the City.
