<br />B. Review of Variance Reauest. The Planning and Zoning Department shall review the <br />application to evaluate whether the application is complete. If the application is complete the <br />Department shall cause the application to be scheduled for a public hearing within thirty (30) <br />davs of the receipt of the application. Public <br />notice for the public hearing before the Citv Commission shall be provided pursuant to Section <br />265.11 of the Land Development Regulations. <br /> <br />C. Review bv the City Commission. The application for a variance mav be granted if the Citv <br />Commission finds: <br /> <br />(I) The variance is not contrarv to the public interest <br /> <br />(2) Special conditions and circumstances do not result from actions of the applicant: <br /> <br />(3) A literal enforcement of the provisions of this Chapter mav result in urmecessarv <br />hardship. <br /> <br />Section 265.65. Penalties. <br /> <br />(I) The Planning and Zoning Director. the Chief Building OfficiaL the Code Enforcement and <br />Licensing Director shall be authorized to enforce the provisions of this Chapter and pursuant <br />to said authorization. shall be empowered to enforce as permitted bv law all violations of <br />this Chapter. <br /> <br />(2) Anv person or entitv found guiltv of violating anv section of this Chapter shall be subiect to <br />a fine UP to $500.00 per occurrence. Each dav such violation is committed. or permitted to <br />continue shall constitute a separate offense and shall be punishable as such hereunder. <br /> <br />Section 3. Severability. The provisions of this Ordinance are declared to be severable and if <br />any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be <br />invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby <br />ordained, that the provisions of this ordinance shall become and be made a part of the code of the <br />City of Surmy Isles Beach, Florida; and that the sections of this ordinance may be renumbered or <br />relettered to accomplish such intentions; and that the word "ordinance" shall be changed to <br />"section" or other appropriate word, as required. <br /> <br />Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the <br />same are hereby repealed. <br /> <br />Section 6. Effective Date.
