<br />ORDINANCE NO. 2006- 2 53 <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF <br />THE CITY OF SUNNY ISLES BEACH, FLORIDA, <br />AMENDING SECTION 250-12 OF THE CODE OF THE <br />CITY OF SUNNY ISLES BEACH RELATING TO THE <br />UTILITY REQUIREMENTS OF NEW CONSTRUCTION <br />AND REHABILITATED STRUCTURES; PROVIDING <br />FOR THE INSTALLATION OF UNDERGROUND <br />SERVICE FACILITIES ON ALL NEW <br />CONSTRUCTION WITHIN THE BOUNDARIES OF <br />THE CITY OF SUNNY ISLES BEACH; PROVIDING <br />FOR SEVERABILITY; PROVIDING FOR REPEALER; <br />PROVIDING FOR INCLUSION IN THE CODE; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, it is the general policy of the City of Sunny Isles Beach to require the <br />underground installation of utilities to the greatest extent feasible; and <br /> <br />WHEREAS, the City of Sunny Isles Beach adopted this underground utility installation <br />policy in order to assure public safety, foster tree preservation, and improve and protect the <br />aesthetic character of the City; and <br /> <br />WHEREAS, currently the Code of the City of Sunny Isles Beach only requires that new <br />construction abutting Collins A venue to the east and west are required to install underground <br />service facilities; and <br /> <br />WHEREAS, the City Commission has determined that it is in the best interest of the <br />residents of the City to promote an environment free from overhead utility service facilities <br />throughout the City of Sunny Isles Beach. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this ordinance <br />upon adoption hereof. <br /> <br />Section 2. <br />follows: <br /> <br />Amendments. Section 250-12 (A) of the City Code is hereby amended to read as <br /> <br />A. All new construction abutting Collins A venue to the east and west and within the <br />Town Center District (TCD), including but not limited to single-family <br />residences (if any), multiple-family dwelling units, hotel and/or time-share <br />units, and commercial properties shall be required to install underground service <br />facilities. The requirements of this section shall not apply to any development <br />proiect in the Town Center District which has been approved by the City <br />Commission prior to the adoption of this amendment provided that the frontage <br />for the proiect is identical to the frontage in the site plan approved by the City <br />Commission. <br /> <br />02006-253 Underground Utilities By Town Center Pk Req Page I of 3 <br />
