<br />ORDINANCE NO. 2006- ~ (p;). <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF <br />THE CITY OF SUNNY ISLES BEACH, FLORIDA, <br />-----AMENDING--l'HE-()I!ERA'fING-AND-GAI!I'fAl. <br />OUTLAY BUDGET FOR FISCAL YEAR 2005-2006 TO <br />ADD EXPENDITURES RELATING TO CAPITAL <br />IMPROVMENT PROJECTS AND LAND <br />ACQUISITION; PROVIDING FOR SEVERABILITY <br />AND RFFRC.TTVR DATK <br /> <br />WHEREAS, by Ordinance No. 2005-233, adopted on September 28, 2005, the City <br />Commission approved the operating budget for Fiscal Year 2005-2006; and <br /> <br />WHEREAS, during Fiscal Year 2005-2006, the City Commission had approved certain <br />capital projects items and a land acquisition item that require budget transfers; and <br /> <br />WHEREAS, the City Manager is proposing this year end budget amendment to ensure <br />that all expenditures are reflected within the budget for the appropriate fiscal year; and <br /> <br />WHEREAS, the City Commission wishes to amend the Fiscal Year 2005-2006 Budget <br />in accordance with the City Code. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this ordinance <br />upon adoption hereof. <br /> <br />Section 2. Budget Amendments. Severability. The provisions of this Ordinance are declared to be severable and if <br />any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be <br />invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />02006~ Budget Amendment Ordinance <br /> <br />Page 1 of2 <br />
