Vera, Assistant City Manager / Service Division <br /> <br />DATE: <br /> <br />10/15/2009 <br /> <br />RE: <br /> <br />Modification of setback requirements to the Town Center <br /> <br />RECOMMENDATION: <br /> <br />Staff recommends adoption of the attached ordinance modifying sections of the Town <br />Center regulations for inconsistencies. <br /> <br />REASONS: <br /> <br />In reviewing the Town Center Code, staff noticed some inconsistencies that needed to be <br />addressed. When going over some of the charts which delineate the height of a building, <br />we noticed that the pedestal height referenced the number of stories but no reference was <br />made as to the maximum height in feet. Also we addressed the setback issue that has <br />been approved at prior hearings regarding the penthouse portion. It was determined at <br />those hearings that having to provide the setback for the penthouse made that almost <br />unusable, therefore variances were granted. This modification would provide the design <br />flexibility that the code was not giving. Overall the modifications will not create a <br />detriment to any adjoining property and will in fact ensure consistency in building <br />development. <br /> <br />ADDITIONAL INFORMATION: <br /> <br />In the future, staff will be reviewing all different areas of the Land Development <br />Regulations to address inconsistencies in building development and will be bringing <br />them before the City Commission for their consideration. <br /> <br />ATTACHMENTS: <br />.
