<br />Any applicant to whom a variance is granted shall be given written notice <br />over the signature of a community official that: <br /> <br />(1) The issuance of a variance to construct a structure below the base flood <br />elevation will result in increased premium rates for flood insurance up to <br />amounts as high as $25.00 for $100.00 of insurance coverage, and <br /> <br />(2) Such construction below the base flood level increases risks to life and <br />property. <br /> <br />A copy of the notice shall be recorded by the City Clerk of the City of Sunny Isles <br />Beach and shall be recorded in a manner so that it appears in the chain of title of the <br />affected parcel of land. <br /> <br />The Building Official will maintain a record of all variance actions, including <br />justification for their issuance, and report such variances issued in its biennial report <br />submitted to the Federal Emergency Management Agency. <br /> <br />Section G. <br /> <br />HISTORIC STUCTURES <br /> <br />Variances may be issued for the repair or rehabilitation of "historic" structures - meeting the <br />definition in this ordinance - upon a determination that the proposed repair or rehabilitation will not <br />preclude the structure's continued designation as a "historic" structure. <br /> <br />Section H. <br /> <br />STRUCTURES IN REGULATORY FLOODWAY. <br /> <br />Variances shall not be issued within any designated floodway if any impact in flood conditions or <br />increase in flood levels during the base flood discharge would result. <br /> <br />ARTICLE VII <br /> <br />SEVERABILITY AND CODIFICATION <br /> <br />Section A. Severability. The provisions of this Ordinance are declared to be severable and if any <br />section, sentence, clause or phrase of the Ordinance shall for any reason be held to be invalid or <br />unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, <br />clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent <br />that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />Section B. Codification. It is the intention of the City Commission and it is hereby ordained that <br />the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach <br />Code. Sections of this Ordinance may be renumbered or re-lettered to accomplish such intentions <br />and that the word "Ordinance" shall be changed to "Section" or other appropriate word. <br /> <br />Section C. Effective Date.
