RESOLUTION NO. 2009-~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING RESOLUTION NO. 07-Z-112, EXTENDING THE TIME REQUIRED TO OBTAIN A BUILDING PERMIT PURSUANT TO ZONING APPLICATION SUBMITTED BY OCEANIC DEVELOPMENT, LLC, (THE "APPLICANT"), (Z2007-01), ON THE PROPERTY LOCATED AT 18915, 18925, 18955, 18965, 18985, 19001, 19025, 19035 ATLANTIC BOULEVARD, IN ACCORDANCE WITH SECTION 265-11(L) OF THE LAND DEVELOPMENT REGULATIONS; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Applicant received a development approval on November 15, 2007 (Resolution No. 07 -Z-112 attached hereto as Exhibit "A"); and WHEREAS, the Applicant's development approval expires within twenty-four (24) months from the date of approval; and WHEREAS, Section 265-11 (L) requires an Applicant to secure a building permit within 24 months from date that the City Commission approved a development project; and WHEREAS, the Applicant is requesting additional time to allow them to obtain the permit and finalize the financing for the project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The recitals stated above are hereby incorporated herein. Section 2. Extension of the Approval Period. The development approval issued to the Applicant shall be extended for a time period not to go beyond May 15, 2010. Section 3. Authority of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date. This Resolutio~ is effective upon adoption.
