Summary Minutes: Regular City Commission Meeting March 19,2009 City of Sunny Isles Beach, Florida coming up on four (4) properties that are in question, and we would extend it for a period not to exceed ten (10) years. Assistant City Manager Jorge Vera asked when the request comes in, will it be done administratively, and Mayor Edelcup said yes. City Attorney Ottinot said the Resolution [Item 100] indicates that it will be done administratively. Mayor Edelcup said to keep in mind that those TDRs indirectly become a great value to this City when they finally do get used because they become the basis of on-going property taxes. Vice Mayor Thaler said the builders can sell them at any time, and Mayor Edelcup said yes, private-to-private. Assistant City Manager Vera asked, in the Resolution [Item 100] can we be as explicit as to the west side because we have ten (10) years to work with this, and anybody can get TDRs on the east side and then they will extend it at $30 on the east side, which is a different cost value than the west side. Mayor Edelcup said to just say that the $30 value will be used for any TDRs that emulated from the west side of the City, but remember where they emulate from, generally are on the west side, it is where they get used and you wouldn't tax them until they are really in place, and so all TDRs at this point, whether they came from the west side or the east side, we don't know where they are going to rest when they are finally built. Commissioner Brezin moved and Vice Mayor Thaler seconded a motion to approve the proposed ordinance on first reading. The motion was approved by a roll call vote of 5-0 in favor. Action: City Clerk Hines read the title, and City Attorney Ottinot reported, noting that this is only a name change.
