Hines, CMC, City Clerk <br /> <br />MEMORANDUM <br /> <br />The Honorable City Commission <br />Rick Conner, Acting City Manager <br /> <br />Hans Ottinot, City Attorne~ <br />March 16, 2009 <br /> <br />Parking Agreement with Fortune International Hospitality LLC. <br />(Le Meridian) <br /> <br />In the zoning report regarding the conditional use application filed by Le Meridian, (the "Applicant") <br />staff indicated that approval was not recommended unless the parking issue is resolved. The parking <br />issue has been resolved between the Applicant and the City. The City has agreed to lease up to 60 <br />spaces to the applicant at either of the parking lots located under the Lehman Causeway or Heritage <br />Park. The City will lease the parking spaces under the following terms: <br /> <br />(I) Lease 20 spaces for the first three (3) years and 40 spaces thereafter; <br /> <br />(2) $65.00 per space on a monthly basis for the first two (2) years of the <br />Agreement to increase to $85,00 per space during the third year, and the <br />rate will be $95.00 per space after the third year. This rate will be subject to <br />a 3% CPI per year; <br /> <br />(3) The Agreement will remam In effect as long as the Beach Club use IS <br />permitted on the site, <br /> <br />During the first two years, the City will receive a yearly lease payment of $15,600,00, The payment <br />will increase to $20,400,00 during the third year. Thereafter, the payment will be $68,400.00 per year <br />subject to a 3% CPI.
