Hines, CMC, City Clerk <br /> <br />MEMORANDUM <br /> <br />Honorable Mayor and City C~ <br /> <br />Hans Ottinot, City AttorneyW'\J <br />July 27,2010 <br /> <br />Amendment to the City's Ethics Code - Post Employment Restrictions <br /> <br />RECOMMENDATION: <br /> <br />This Ordinance is presented for your approval. <br /> <br />REASONS: <br /> <br />The purpose of the amendatory Ordinance is to confirm and ratify the City's Two Year Post <br />Employment Restriction for former employees and elected officials. When the City adopted its <br />Ethics Code, it did so with a clear legislative intent on guarding against former officials or <br />employees from using their influence to corrupt or unduly influence the decision making process <br />of staff, the City Commission, and its Boards. The Ethics Code of Miami-Dade County is merely <br />a minimum standard of ethical conduct for municipal officials. The City has the absolute right <br />under the law to adopt a more stringent Ethics Code. <br /> <br />The City Commission has found post-employment restnctIOn to be good public policy by <br />adopting a more restrictive policy over the years, The City Commission has determined that <br />employees recently separated from employment with the City are presumed to have an advantage <br />over others if they are allowed to exert undue influence, communicate in any manner with the <br />intent to influence a government decision, give the appearance of corruption or impropriety, or <br />otherwise subvert the interests of the City to those of a current or prospective employer or any <br />other person. <br /> <br />This amendatory Ordinance is to affirm that public officials and employees shall be free from <br />conflicts of interest, personal gain, undue influence, corruption, or any appearance of impropriety <br />during the government decision making process during judicial, quasi judicial or other <br />proceedings, More precisely, the City wishes to affirm and clarify that the post employment <br />restrictions set forth in Chapter 33-3(P) of the City Codc arc unequivocal and absolute <br /> <br />Date <br /> <br />?)A <br />S~ (0- lO <br /> <br />Agenda Item <br />
