<br />implied requirement of the Contract Documents. "Minor Detail" shall include the concept of <br />substantially identical components, where the price of each such component is small. The <br />quality and quantity of the equipment, material, or part so furnished shall conform to trade <br />standards and be compatible with the type, composition, strength, size and profile of the <br />equipment, materials or parts otherwise specified in the Contract Documents. <br /> <br />ARTICLE 27. NOTICES <br /> <br />Whenever either party desires to give written notice to the other, such must be addressed to the <br />party for whom it is intended at the place last specified; and the place for giving of notice shall <br />remain such until it shall have been changed by written notice given in accordance with the <br />provisions of this Article. Notice shall be deemed given on the date received or within 3 days of <br />mailing, if mailed through the United States Postal Service. Notice shall be deemed given on <br />the date sent via e-mail or facsimile. Notice shall be deemed given via courier/delivery service <br />upon the initial delivery date by the courier/delivery service. INDEMNIFICATION <br /> <br />28.1 Contractor shall indemnify, defend and hold harmless the City, its officers, agents, <br />directors, and employees, from any and all claims, liabilities, damages, losses, and costs, <br />including, but not limited to reasonable attorney's fees, and costs to the extent caused by the <br />negligence, recklessness or intentional wrongful misconduct of Contractor and/or persons <br />employed or utilized by Contractor in the performance of this Agreement. Contractor's <br />obligations hereunder shall apply even if part of the damage or injury is caused by the City, its <br />officers, agents, directors, or employees.
