ARTICLE 11 <br />SEVERABILITY CLAUSE AND ZIPPER CLAUSE <br />Section 1. Should any provision of this collective bargaining agreement, or any part <br />thereof, be rendered or declared invalid by reason of any existing or subsequently enacted state or <br />federal law, or by any decree of a court of competent jurisdiction, all other articles and <br />sections of this Agreement shall remain in full force and effect for the duration of this <br />Agreement. The parties agree to immediately meet and confer concerning any invalidated <br />provision(s). <br />Section 2. The parties acknowledge that during the negotiations which resulted in this <br />Agreement, each had the unlimited right and opportunity to make demands and proposals with respect to <br />any subject or matter not removed by law from the area of collective bargaining and that the <br />understanding and agreement arrived at by the parties after the exercise of that right and opportunity <br />are set forth in this Agreement. Therefore, the City and the Union, for the life of this Agreement, each <br />voluntarily and unqualifiedly waives the right and each agrees that the other shall not be obligated to <br />bargain collectively with respect to any subject or matter referred to or covered by this Agreement <br />and with respect to any subject or matter not specifically referred to or covered in this Agreement, <br />even though such subject or matter may not have been within the knowledge and -contemplation of <br />either or both of the parties at the time they negotiated or signed this Agreement. Except as provided <br />by Article 12 hereof, this Agreement contains the entire Agreement of the parties on all matters <br />relative to wages, hours, terms and conditions of employment as well as all other matters, which <br />were or could have been negotiated prior to the execution of this Agreement. This Section does <br />not prohibit the parties from entering into negotiations concerning the terms of a successor <br />Agreement. <br />-12-1Page <br />
