ARTICLE 28 <br />DRUG FREE WORKPLACE <br />Section 1. The City and the Association recognize that employee substance and/or alcohol <br />abuse may have an adverse effect on Departmental operations as well as the image of employees and <br />the safety of the general public. Therefore, the City has a zero tolerance for employee drug use. The <br />parties agree that the Department shall have the right and authority to require employees to submit to <br />drug and/or alcohol testing designed to detect the presence of any controlled substance, narcotic <br />drug, or alcohol under the guidelines stated herein and according to departmental policy as stated in <br />the General Orders. <br />A. An employee who suffers an injury in the line of duty may be required to submit to a test <br />for the presence of controlled substances, narcotic drugs or alcohol immediately after the <br />injury or accident, if there is reasonable belief on the part of a supervisor that the employee <br />is under the influence of the aforementioned substance. That reasonable belief shall be <br />articulated and documented by the supervisor and forwarded up the chain of command. <br />Determination for testing shall then be decided by the Chief of Police or his designee <br />following review of the reasonable belief, consultation with the supervisory command and <br />documentation of such belief, requiring testing. <br />B. If an employee's superior officer has a reasonable belief that the employee is under the <br />influence of the aforementioned substances, or is in violation of the Departmental policy <br />regarding use of such substance, an employee may be required to submit to a test to detect <br />the presence of such. That reasonable belief shall be articulated and documented by the <br />supervisor and forwarded up the chain of command. Determination of testing shall then be <br />ultimately decided by the Chief of Police of his designee following review of the <br />circumstances, documentation of the reasonable belief and consultation with the <br />supervisory command. <br />C. If an injured employee is receiving benefits from Worker's Compensation, the Chief of <br />Police or his designee, reserves the right to randomly test such employee for use of the <br />aforementioned controlled substance, narcotic drugs or alcohol, while he/she is receiving <br />such benefits. <br />-33-1Page <br />
