<br />Summary Minutes: Regular City Commission Meeting September 16,20]0 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />Mayor Edelcup clarified that we have an option on our part with the County and if staff <br />would recommend at some future date that if the actual transfer of spaces were to take place <br />then that would come before the Commission. Commissioner Goodman asked if we still <br />have the 29 parking spaces in the building, and Mayor Edelcup said yes. Commissioner <br />Goodman said he is concerned about taking the parking spaces completely away from there <br />because of the handicapped parking, and he would like handicapped parking considered. <br />Mayor Edelcup said he agrees with Commissioner Goodman since we will still have a <br />restaurant on the Pier, people still need to park there, and ifit were to come up before him, he <br />would probably not be in favor of giving up those spaces. <br /> <br />Vice Mayor Thaler moved and Commissioner Scholl seconded a motion to approve this <br />resolution. Resolution No. 2010-1607 was adopted by a voice vote of 5-0 in favor. <br /> <br />10J. A Resolution of the City Commission ofthe City of Sunny Isles Beach, Florida, Ratifying the <br />Approval of Change Order No.4 to Agreement with Coastal Construction Company for <br />Professional Construction Services for the Heritage Park and Parking Garage Project, to <br />Begin Construction on the Park Portion of Heritage Park, in an Amount Not to Exceed <br />$1,454,479.00, Attached Hereto as Exhibit "A"; Authorizing the City Manager to Do All <br />Things Necessary to Effectuate this Resolution; Providing for an Effective Date. <br /> <br />Action: City Clerk Hines read the title, and City Manager Conner reported noting that <br />Change Order No.4 does not finish the Park because before the finished Park can be put into <br />place, a great amount of infrastructure for a potentially more developed future Park needs to <br />be in place. In this Change Order it gets us to the $9.5 Million and it takes care of a <br />tremendous improvement to the underground drainage system, it puts in a full electrical <br />system with three-phase power that can allow all types of additional development such as a <br />decorative lighting system, street lights, pathway lights, etc. The final amount will come to <br />the Commission next month to complete the Park surface. <br /> <br />Public Speakers: Raquel Mass; Trina Duluc; <br /> <br />Commissioner Scholl noted on the Change Order, in "Amount of Days per this Change <br />Order" and "New Contract Completion Date" says "To be Determined". How do we <br />preserve our liquidated damages in the original contract if this Change Order leaves the <br />additional work days open-ended, and City Manager Conner said that is an error, he will go <br />back to the last Change Order which did have the days, and make certain there is no change <br />to that and fill it in. Commissioner Scholl clarified that they will be approving it with no <br />time change, we are scratching out "to be determined" and putting in zero, and the new <br />completion date would be the same as the old completion date, for the 20 days of the <br />previous Change Order. City Manager Conner noted that the original paperwork was done <br />on August la, and we were going to have it ready on the Change Order. <br /> <br />Vice Mayor Thaler said we are not finished with the basic park with this number of $9.2 <br />Million, and City Manager Conner said no, there will be an additional $2.6 Million as we <br />stated in the Budget. Mayor Edelcup clarified that this is for the amenities. <br /> <br />Commissioner Goodman said he thought the total cost of the Park would be $9.2 Million, <br />10 <br />
