Summary Minutes: Regular City Commission Meeting September 16, 20 I 0

City of Sunny Isles Beach, Florida

the day. Nobody is going to come to the Seaquarium, the only one that is going to gain from
it is the one who is going to develop it, and then he is going to abandon it because there is no
way in the world he can hold it, no money for admission to attend it.

Mayor Edelcup said when it finally does get presented to us, he believes it has been
suggested that the aquarium would be owned and operated by the developing group and they
would be paying all the expenses as it is related to that. Any contractual arrangement that we
would have as it regards to leasing that property he is sure that the City Attorney would have
the Covenants and the Lease to make sure that they maintain the property in such a matter as
to be fit and usable, and to the extent that ifthey were to walk away from that property there
would be a provision for the decommissioning of the aquarium, and Mr. Steiger said right
but at the end of the day it will be an empty building. Mayor Edelcup said it mayor may not
be but the aquarium is inside of a building that is planned to have, as Vice Mayor Thaler
pointed out, some 20,000 square feet of other commercial retail space, and in addition
another 20,000 square feet of restaurant and banquet space in that building. The aquarium is
an adjunct as he sees it right now, to an entire building for which a lot of the commercial
revenue will come from things other than the fact that there is an aquarium inside of a
building that happens to have banquet halls, restaurants and other retail shops in there. It is
different than Joe Robbie, who is depending on the City to finance the deal, in this particular
case the City is not financing the deal, they are putting all of their own money into it.

Mr. Steiger said that we have on the island a contractor by the name of Ten ex that is getting
bids in the City, and extensions of contract, and he doesn't feel he should be awarded any
more contracts. If you go to Collins Avenue on the sidewalk, there are potholes everywhere,
and right at the entrance to City Hall. Every day on the Island he digs another section and
puts another pipe in, and FPL is mad because they don't have pipes. It is also a year over the
estimated time and over budget. City Manager Conner said in a public forum he is not going
to respond on the credibility or capabilities of a contractor but he will say that that project is
not over budget, everything that is being done is in the original price, however, he agrees it is
way over schedule. Mayor Edelcup suggested that he and the City Manager meet in his
office, and Mr. Steiger said no, he just wanted to bring it to the City's attention, if you go
right out here to the entrance you will see that the pavers are sinking, it wasn't properly done,
it was not compacted. City Manager Conner said since it is the end of the meeting, he will
walk out there with Mr. Steiger.

14. ADJOURNMENT

Mayor Edelcup adjourned the meeting at 9: 13 p.m.

Respectfully submitted by:

~~~
Jane A:,Hines, CMC, City Clerk
'- .
..
Approved by the City Commission on Oct. 14, 2010
r.
~.. .
19
