All insurance policies <br />required shall be issued by companies authorized to do business under the laws of the State of <br />Florida. <br /> <br />Failure to maintain the insurance required shall be just grounds for suspension or termination of the <br />contract. <br /> <br />2.15 COlVIPLAINTS AND DISPUTES <br /> <br />All complaints regarding the personnel conduct of the City's Police Department in connection with <br />tows under this RFP shall be forwarded to the Chief of Police or his designee within 3 (three) days <br />of the alleged incident. <br /> <br />All complaints regarding towing procedures or incidents that occurred in the City shall be <br />forwarded to the Chief of Police or his designee within 3 (three) business days of the alleged <br />incident. If the incident requires formal investigation, the Contractor will be notified of the <br />complaint by certified mail. The Contractor will have five (5) business days to reply to the <br />complaint in writing. After the investigation is completed, a memo will be prepared by the Chief of <br />Police or his designee regarding the outcome. At his discretion, the Chief of Police may reprimand <br />the Contractor in writing or suspend the Contractor for up to 96 hours during their towing month(s). <br />The Chief of Police will report directly to the City Manager for suspensions of more than 96 hours, <br />or for the removal of Contractors from the towing rotation. <br /> <br />The Contractor agrees that any complaints received by the City concerning misconduct on the part <br />of the Contractor, such as excessive charges, poor business practices, damage to vehicles, etc., that <br />cannot be resolved between the Contractor and the City's Police Chief or his designee, will be referred <br />to the Police Chiefs office for appropriate action. If the complaint is not resolved to the satisfaction of <br />the Police Chief or the owner of the vehicle, it may be referred to the City Manager's office. <br /> <br />2.16 NO DISCRIMINATION <br /> <br />In accordance with Dade County Resolution 9601, the Contractor agrees to make no discrimination <br />because of race, color, creed, or natural origin, with respect to employment of personnel on this project, <br />and that all persons having the experience and skill necessary to perform the work shall be afforded <br />equal opportunity of employment for the work to be performed for this service. <br /> <br />2.17 INSPECTIONS <br /> <br />The Contractor agrees that all records, equipment, personnel, office, and storage facilities will be <br />subject to periodic inspections by properly authorized representatives of the City. <br /> <br />2.18 ElVIPLOYEES <br /> <br />The Contractor agrees that all employees will be fingerprinted, photographed, subject to a <br />background check, and issued an I.D. card by the City Contractor.
