<br />premises free from accumulations of waste materials, rubbish and other debris resulting from the <br />Work. At the completion of the Work CONTRACTOR shall remove all waste materials, rubbish <br />and debris from and about the premises as well as all tools, appliances, equipment and machinery, <br />and surplus materials, and shall leave the site clean and ready for occupancy by CITY. <br />CONTRACTOR shall restore to original condition all property not designated for alteration by the <br />Contract Documents. <br /> <br />6.17.3 CONTRACTOR shall not load nor permit any part of any structure to be loaded in <br />any manner that will endanger the structure, nor shall CONTRACTOR subject any part of the Work <br />or adjacent property to stresses or pressures that will endanger it. <br /> <br />6.18 <br /> <br />Access to Work: <br /> <br />CONTRACTOR shall provide CITY, CITY'S consultants, representatives and <br />personnel, independent testing laboratories and governmental agencies with jurisdictional interests <br />with access to the work at reasonable times for their observation, inspection and testing. <br />CONTRACTOR shall provide them proper and safe conditions for such access and advise them of <br />CONTRACTOR'S site safety procedures and programs so that they may comply therewith. <br /> <br />6.19 <br /> <br />Safety and Protection: <br /> <br />6.19.1 CONTRACTOR shall be responsible for initiating, maintaining and supervising all <br />safety precautions and programs in connection with the Work to prevent damage, injury or loss to <br />all employees on the work site and other persons and organizations who may be affected thereby; <br />all the Work and materials and equipment to be incorporated therein, whether in storage on or off <br />the site; and other property at the site or adjacent thereto. <br /> <br />6.19.2 CONTRACTOR shall comply with all applicable laws and regulations of any public <br />body having jurisdiction for the safety of persons or property or to protect them from damage, <br />injury or loss. <br /> <br />6.20 <br /> <br />Indemnification: <br /> <br />GENERAL INDEMNIFICATION: The parties agree that one percent (1%) of the <br />total compensation paid to CONTRACTOR for the Work under this Agreement shall constitute <br />specific consideration to CONTRACTOR for the indemnification to be provided under this <br />Agreement. CONTRACTOR shall indemnifY, defend, save and hold harmless the CITY and the <br />CITY's elected officials, public employees, consultants and separate contractors, any of their <br />subcontractors, sub-subcontractors, agents and employees from and against claims, damages, losses <br />and expenses, including but not limited to attorneys' fees, arising out of or resulting from <br />performance of the Work. These indemnification obligations shall be limited to claims, damages, <br />losses or expenses (1) that are attributable to bodily injury, sickness, disease or death, or to injury to <br />or destruction of tangible property (other than the Work itself) including loss of use resulting <br />therefrom, and (2) to the extent such claims, damages, losses or expenses are caused in whole or in <br />part by negligent acts or omissions of the contractors, anyone directly or indirectly employed by <br /> <br />14 <br />
