SUNNYISLES <br />1703779 City of Sunny Isles Beach <br />TOTAL DISABILITY <br />*or the Premier Plan, Total Disability means that, due to an injury or sickness, an employee is unable: <br />1. During the ELIMINATION PERIOD and the "OWN OCCUPATION" Period, to perform each of the <br />material and substantial duties of his or her own occupation; and <br />2. After the "OWN OCCUPATION" Period, to perform each of the material and substantial duties of any <br />occupation which his or her training, education or experience will reasonably allow. <br />The loss of a professional license, an occupational license or certification or a driver's license for any reason <br />does not, by itself, constitute total disability. <br />For the Value Plan, Total Disability means that, due to an injury or sickness, an employee is unable: <br />1. During the ELIMINATION PERIOD and the "OWN OCCUPATION" Period, to perform each of the <br />material and substantial duties of his or her own occupation; and <br />2. After the "OWN OCCUPATION" Period, to perform each of the substantial and material duties of any <br />gainful occupation. A gainful occupation is any occupation in which the employee: <br />a) is or reasonably could become qualified, considering his /her education, training, experience, <br />physical and mental abilities; <br />b) could reasonably find employment, considering the demands of the national labor force; and <br />c) could earn, or reasonably expect to earn, a before tax income of at least 60% of his /her predisability <br />income within 12 months of returning to work. <br />The loss of a professional license, an occupational license or certification or a driver's license for any reason <br />does not, by itself, constitute total disability. <br />aA p" WN OCCUPATION PERIOD: To Age 65/24 Months (Option 1.00) <br />period beginning at the end of the elimination period and ending: <br />1. at the end of the maximum benefit period for an employee who is an executive or administrator; or <br />2. 24 months later for all other employees. <br />The loss of a professional license, an occupational license or certification, or a driver's license does not, by <br />itself, constitute total disability. <br />MONTHLY TOTAL DISABILITY BENEFIT: After the Elimination Period is satisfied, the LTD policy provides a <br />monthly benefit for an employee who is totally disabled and under a physician's regular care. This monthly <br />total disability benefit equals: <br />- the benefit percentage times the insured's predisability income, up to the maximum monthly benefit; <br />- minus other income benefits. <br />This benefit amount will not be less than the minimum monthly benefit. <br />The policy also provides a monthly benefit for an employee who is partially disabled, under a physician's <br />regular care, and sustaining a specified percentage of lost earnings. See the Partial Disability Benefit section <br />of this proposal. <br />RECURRENT DISABILITY means a disability which is related to or due to the same cause or causes of a prior <br />disability for which a monthly benefit was payable. A recurrent disability: <br />- will be treated as part of the prior disability if, after receiving policy benefits, the employee returns to his or <br />her regular occupation full -time for less than 6 months. <br />will be treated as a new period of disability if, after receiving policy benefits, an employee returns to his or <br />her regular occupation full -time for 6 months or more.
