PART IV <br />GENERAL SPECIFICATIONS <br />1. Definitions: <br />Whenever the following terms pronouns in place of them appear in the Contract <br />Documents, the intent and meaning shall be interpreted as follows: <br />a. City: Sunny Isles Beach, Florida, the public body, agency, or instrumentality, <br />which is a party her to and for which this Contract is to performed. <br />b. Commission or City Commissioner: The City Commissioner of Sunny Isles <br />Beach the legal representative of the City, or their successors in office. <br />C. City Manager: The administrative agent acting for and on behalf of the <br />City Commission. <br />d. Department: The "Florida Department of Transportation Standard <br />Specifications for Road and Bridge Construction" 2000 edition, which are Part of <br />the Contract Documents. Whenever the term " Department ", "State of Florida <br />Department of Transportation" or " Director" appears, it shall be understood to <br />mean the "City ": or the "Engineer" as applicable, and as defined herein. <br />e. Engineer: The City's Director of Public Works or his authorized assistants. <br />f. Force Account: Basis of Payment for "Extra Work" <br />g. Inspector: An authorized representative of the "Engineer" assigned to make all <br />necessary inspection of the materials furnished by the Contractor and to the work <br />performed by the contractor. <br />h. Bidder: Any individual, firm or corporation submitting a proposal for the work <br />contemplated, acting directly or through a duly authorized representative. <br />i. Contractor: The party of the second part to the Contract. The person, firm, or <br />corporation, holders of a current Certificate of Competency applicable to the type <br />to work to be performed, with whom a Contract has been made directly or <br />through accredited representatives that may have entered into a Contract with the <br />City of Sunny Isles Beach, (City) Florida, and who is primarily liable for the <br />acceptable performance of the work for which he has contracted and also for the <br />payment to all legal debts pertaining to the work. <br />j. Subcontractor: A person, firm or corporation supplying labor and materials or <br />labor for work under subcontract at the site of the project. <br />General Specifications Page 1 of 16 <br />
