PART FIVE: SPECIAL CO.ND'ITIONS S <br /> 5.1 CONFIDENTIALITY <br /> 5.1.1 Any information relating to the products, customers, business, marketing plans and <br /> policies of the State or its affiliates, supplied to Contractor by or at the direction of the <br /> State or acquired by Contractor in the course of providing services to the State, or <br /> developed by Contractor in carrying out Contractor's duties under the Contract, must be <br /> deemed to be confidential and proprietary information of the State and the exclusive <br /> property of the State. <br /> 5.1.2 Notwithstanding any provisions to the contrary, the parties shall not be required to <br /> disclose to the public any materials protected by law and disclosure of any confidential <br /> information received by the State of Florida will be governed by the provisions of the <br /> Florida Public Records Act, Chapter 119, Florida Statutes and exceptions thereto. <br /> 5.1.3 Contractor shall not sell or distribute a list of participating Eligible Users, State Agencies <br /> or their cardholders, their addresses, card account numbers or any other information to <br /> any person, firm, account, or other party for any purpose.
